How to file a maintainance case....

My husband and inlaws house

drive me out from their home

after six month of marriage and filed a divorce case against me. I am now staying

with my parents . My husband is serving in a MNC company and has landed property ,home and bank deposites . Now how can I file a maintanance case and what is the rules and

procedures for it ? Please help and guide .

You can ask for maintainence on basis of facts u/s 125 of Cr Pc and later under HMA.

You will have to contact an advocate for the same.

Your facts are incomplete. To provide an appropriate opinion, you should inform :

(a) What is the stage of proceedings in matrimonial case?

(b) Have you appeared in court after you received the summons?

(c) Have you already filed your written statement to the matrimonial petition?

(d) Are you working?

(e) what is your husband's income?

(f) is there any issue from marriage?

(g) What is your religion? How was the marriage solemnised?

However, based upon your information, and assuming that the parties are Hindu, you are advised to immediately

filed an application u/s 24 of the HMA seeking litigation expenses and maintenance for yourself.

You should not file your written statement to the divorce petition till you are paid the litigation expense and maintenance.
