Legal Question in Family Law in India

I filed a 406,498A case against my in-laws and husband. Also he admitted some of the items which Ieft in my matrimonial home and rest of them he is saying that I took away with me while leaving the house.

Upon filing of FIR, my husband applied for an anticipatory bail. My in-laws got the bail but my husband'a bail was rejected.

Q1.) After how much time can my husband appy for a bai in HIgh court ??

Q2.) Somebody told me that getting a bail from high court is extremely easy and anyone can get bail from High Court very easily. Is it True ??

Q3.) Will the hight court give the bail to the boy without having him give me any conditional value of the Jewellery which is pendin with the boy ( Which he is sayin I took away while leavin the home). I know it will depend upon the discretion of the court but what is the eneral trend in these kind of cases when a Girl is requesting that the Jewellery is remaining with the in-laws and In-laws are sayin that the Jewellery was taken away by the girl.

There is no time limit to file anticipatory bail in High court, he can file any time till his arrest.

Furrther, getting bail from High court is not so tough but not so easy also.

Further, if you will contest though your advocate in high court then court will also hear you and can put some conditon while bail.

Regarding query no 3), High Court will not take into account the value of jewellery allegedly with your husband for grant of bail.

Bail is based on the gravity of offence and will have no reference to value of the jewellery.

It may not be proper to comment on a order which may possibly be passed by the courts. Pursue your remedy properly and wait for the orders.
