Legal Question in Family Law in India

i have filed domestic violence case against my husband and in laws on 9th may 2011. till date court could not pass order for interim maintenance. my husband's lawyer argues that i m working which is not true.

now i heard that he is going to abroad for business trip. can he go abroad when such case is going on?

if he run away to abroad how long court take to declare him absconded. is there any provision in law to stop him going abroad?

i m really scared of them as i feel they might hurt me....moreover all my gold, silver and gift given by my parents and relatives r with him.

can court help me to get back all my things from him as well as ask him for maintenance

You may request the court to expediate your case or atleast pass interim orders and/or direct him not to travel abroad till the case is decided. Some courts have pass such orders in DV cases. You may request the court to direct him to return the stridhan.

Have you asked for return of stridhan, maintenance and protection orders in your DV application??

No according to me no one can charge for anything above printed M.R.P. But yes other charges such as Service Tax/Luxury Tax, V.A.T. and other charges can be charged.

First of all you may request the Court to expedite the proceedings. Further you may also request the Court to interfere in the travelling of your husband. In which case if it is really necessary for him to travel he must file some surety before leaving the Country.

You dont have get scared , have you filed a complaint u/s 498a etc against your husband and his family ? I think your lawyer is not very effective in court as application u/s 23 of D V act could have got you some interim maintenance. Try to pursue the criminal remedy available to you.
