Legal Question in Family Law in India

i filed DV case against husband and father inlaw in 2009.they hardly appear in hearings.i feel my brother inlaw also be involved as he had major role.

so should DV case be refiled to include him also as respondednt?or should i just put an application in court to make him also respondendent?

please tell me exact procedure.
