Hi, I have filed restitution of conjugal rights in Mumbai Bandra court for my wife and baby in 2010.After filing the case from 2010 till now 2012 my wife has only come twice in a court. She has also files CRPC 125 case in Belapur and she not coming there also. Now my wife is planning to move the case to Punjab where she is staying. Now i have 2 question in this which case she can move and for moving any case to mumbai where she has to move the petition and is it so easy to move one case from one place to another.

you may file a petition for RCR in Punjab courts and withdraw your case from family court Bandra by seeking a leave to file the same in Punjab. the case can be filed where the jurisdiction as per HMA is made out.
a) she may seek transfer of her cases to Punjab;
b) she may also initiate fresh proceedings in Punjab, if any remedy is available.
You should start payment of maintenance immediately and try for a compromise.
