Filing dva

Hi,

I have been advised by my lawyer to file DVA against my husband and mother in-law as they refuse to take me bk to their house. I have been living with my parents for the last 1 year. what if my husband refuses for a compromise ..he is also fighting for a divorce. I want to stay with him. Can DVA force him to takle me back? Whar will be the imnplications if he refuses? I am earning 30k every month.

DVA action may not force him to take you back; there is no law which may force an unwilling husband to live with his wife;

However, DVA action may be coercive, he may be detained/imprisoned if an allegation of violence is established; and you may be awarded adequate compensation even though you may be earning.

Your lawyer's advice sounds good. I would recommend pursuing course of action being suggested.

If your husband is not willing to stay with you there is no legal system or law provision to force him to stay with you.

You may seek compensation from him and follow your Lawyer instruction.
