Filing DVA need help-second ques

pls refer prev ques- I m living with my parents for d last 1 year. hubby is fighting for divorce. I want 2 stay with him. I am earning 30k every month. I had a hearing this month n my hubby's lawyer was not present, my lawyer has requested the judge to put case in mediation..can my hubby's lawyer refuse for mediation...if they refuse will the judge still put the case in mediation. I am also filing a DVA case against my mom-in-law and sis-in-law who have tortured me. will they also be summoned alongwith my hubby as they are the main culprits.The divorce case referred above is going on in TIS HAZARI. How much time will the DVA case take to reslove the matter. I had earlier filed a case in women cell of delhi against my hubby, mom-in-law and sis-in-law but closed it temporarily thinking my hubby might agree for a compromise. Can i file a fresh complaint in women cell and also add my father in-law's name in DVA n women cell case. Bec he also supported my mom-in-law indirectly. His name was not recorded in my previous complaint. Can my hubby get a divorce if i do not agree? he has no proof 2 support. My lawyer has also advised 2 file a case to get bk my istridhan. We wud be filing these cases after the next court hearing of 30/04/9

Your lawyer has rightly advised you to seek return of your istridhan. The DVA case may be clubbed with the divorce case by filing suitable application. You may add the name of your father in law also if required. The withdrawal of your first complaint may go against you. You may follow the advice of your lawyer conducting your case in Tis Hazari Courts, Delhi.

matter will be refered for mediation only if both parties agree. you cannot file DV case agins tlaides
