Legal Question in Family Law in India

A friend of mine separated from his wife over 9 years ago- in 2001. He applied for a divorce in 2004 in Bhopal. Since his home town is in Karnataka, the case was transferred there. Since then, he has been appearing for hearings regularly and has been paying maintenance monthly.

His wife does not appear for hearings at all. The case is simply dragging on and there has been NO result until now.

What should he do..? His lawyers are not advising him correctly he feels.

Pl advise and oblige.

Has the maintanace case been decided if not get both the cases of divorce and maintanace to be heared together. In this way she will be forced to appear in your case also.

Keep paying mainteanance and wait for the amendment in law providing for divorce on the ground of "irretrievable breakdown of marriage".
