good day sir

i got married to a girl from ludhiana on 12 october 2010 but sooner i realized she married me for money just because i m in merchant navy she married me she and her family were only interested in my money .they started hinting me indirectly to giv e money to their daughter whenever she comes to her mos house and that should be minimum 25 000 rs as her other sister also gets so should she .when there demands were not met her mother did not send her back after her exams were finished for months and started putting nonsense conditions for sending her back she started saying wrong things about my parents and started saying to leave house and stay somehere else

when we contacted their relatives to settle the matter they filed a fake case of dowry for 30 lakh in ludhiana punjabpay 20 lakh actual money spend by them is not more then 12 lakh and that even not as doery as of now i m out of india and she has not come home for last 7 months

her family has not left any stone unturned to make us feel feel bad in society ,i have few proof of her misdeeds on phone and chats where i can prove my self

please let me know 2 thin

as of now she has closed the case but in case she files back then do we have to go to jail because i know I m right we have not done anything we are caught in their trap and she is easily taking my hard earned money which i want to save my money now when i am back i am ready to pay their genuine money spend on marriage

Please guide me weather i can take divorce even when dowry case is going and how fast and she has threatened me that she will put such a case thet my passport will be confiscated so is their any way where i can fight the case and can continue with my job also i mean i dont get hindered by this case else my career will ruin for months

how fast can i can get divorce when she is out of my home for 7 months as i am 28 now and she is 21 since her mother said nothing will happen to us your sons age is going we will fight for years so pay the money this is what her mother said she also said if we dont do as she said then her lawyer will see the things she will still get 20 lakh and other remaining 10 lakh lawyer will take

Just donot succumb and do not decide on the basis of what they say. In each case court has to see the facts of the case. Jail or no jail depends upon the allegations in the FIR. There is a provision of Anticipatory Bail.

Yes while the dowry case is on, you may still file a case for divorce.

First decide as to what exactly do you want not that what they say or what her mother says. Based on your decision act in that direction. If you decide to seperate from her, you may file a case on the grounds of cruelty citing incidents which caused mental cruelty to you.

Once one year of seperation is completed you may add the ground of desertion
