Can apply if natural guardians not available

Even if natural guardians or parents are alive, grand-parents may maintain an application depending upon facts of the case. They may need to establish that child's parents are unfit to be 'guardian' and that it will be in the interest of and for welfare of the child that they are more suited to be appointed guardian.

if natural guardians not available only then. Else some extra ordinary case is to be established.
