I my H1b husband has filed a divorced case against me in India. Presently I am in India with H4.
In this situation can I go and stay with my husband at USA. Do I posses that Right?

filing a divorce does not take away the right of residence from you. anyhow, i would like to go through the petition that you has been filed.

Instead of using H4, you should rather decide about your stand in divorce case - to contest or not; and what action you propose taking in defence with regard to your alimony, istridhan etc.
