Hama 1956

I have been married for over a year. After marriage I discovered that my husband had been a drug addict for 8 years and his legs were full of scars due to injecting himself. He has terrible mood swings. I still decided to continue the marriage and conceived. My husband tortured me during my entire pregnancy mentally and sent me to my parents home for the delivery. I have a daughter now ged 8 months. He refuses to take us back as he says he wanted a son. I have filed a petition under HAMA sec 18 and sec 20. He is earning about 22 lakhs a year. I earn about 3 lakhs but as i teach my earnings are wages and contractual. I dont have a permanent job. i have sued him for 1.25 lakhs a month. I want to know how much can i expect as maintenance for myself and my infant daughter.

A wife and daughter are entitled to live the same life style and position, in which the husband lives. so, if the husband earns 22 Lack year and if u able to prove the same, then u can get 60,000 and around money for you and daughter.

well, if he is earning 22 lacs p.a., you may expect about 10 lacs p.a. for yourself and your daughter. However, keeping in view the torture you have suffered, your demand for 1.5 lacs p.m. may be justified.

If the husband income is Rs. 22 lacs per year and if you have sufficient evidences to prove them then you are entitled to get 60,000 on an average.
