I am a handicapped person (paralysed due to accident). my wife of 2 years stole all the gold ornaments and cash of my family and run away with a feriwala. A FIR was lodged and she was captured from one of the house of her relatives but that feriwala was absconding. now I am not ready to live with her and she has filled a case under crpc 125. As i have no income and reside with my parents, who will pay for her maintenance, if awarded by magistrate. and is this adultery ?

yes it is adultery. but that has to be proved by you with evidences.

If you are handicapped and not earning anything she can not seek any nmaintenace from you. Moreover, if she is working you can seek maintance from her. further you may sue her for adultery and it is one of the ground for divorce. As you have mentioned that an FIR is registered to this effect this may give you evidence to prove adultery.
