Legal Question in Family Law in India

Harassment for false dowry allegation

I am under constant threat from my wife by the following absolutely false allegations -

1. I am harassing her for money/dowry.

It is a public knowledge that-

1. I had not taken a single rupee from my inlaws during

marriage. In fact , I hadn't taken any articles usually

given during marriage. I hadn't accepted any marriage

gift also.My marriage invitation card will prove that.

I earn sufficient money to lead a decent life.I lead a

very simple lifestyle.I spend around 90% of my family

expenses.

She is also working . Instead of asking and

harassing her for money, my and her bank statement will

prove that number of times I helped her with large

amount of money for housing projects, car etc.

Still she prefers to threaten me with false case of

harassment for dowry. My records are open for anybody

to check.

Since Indian laws in such cases are biased towards

women, I fear that someday I may be flasely implicated

by her.

Pl suggest some preventive measure at the earliest.

Re: Harassment for false dowry allegation

Dear Gentleman:

I sympathise with your situation but in order to help you out, I need to know more facts. The following are the most important facts for one to know before any opinion can be given:

1.Date of Marriage

2.Religion of both husband and wife

3.Any child out of wedlock

4.marriage according to what rites? say hindu/special marriage etc..

5.place of marriage.

6.What is the evidence to support "It is a public knowledge that- 1. I had not taken a single rupee from my inlaws during marriage. In fact , I hadn't taken any articles usually given during marriage. I hadn't accepted any marriage gift also."

7. I personally would need to look into the invitation card and the other documentary evidence, if the above can be precipitated or substantiated.

8.If all what you say is very well evident legally, we might have to take precautionary measures, which would depend upon the answers to questions I have raised above.

You may either email me the answers or in case you can conveniently meet me in person in my 0ffice by prior appointment over phone at 3383259 or 9810129750 then we can discuss and resolve to find remeady.

Re: Harassment for false dowry allegation

In the given circumstances, an application for divorce may be contemplated by you.

In any event, you should apply for and obtain an anticipatory bail, in case your wife is advised and files a complaint against you u/s 498A of Criminal Procedure Code.
