Legal Question in Family Law in India
Hello,i filed 498A before 2 months, but the police didnt take any action, myinlaws got bail and even my husband applied for anticipatory bail with out arrest and the police are saying that he may even get bail. They put all false statements for getting bail, even before applying affidavit in high court my inlaws got bail(i.e they got stay for 3 weeks, but they got bail within two weeks),i didnt even know that they got bail, the police said false date for bail,my counter was gone mere waste. Now the same is happening with my husband. Now just i want to cancel my 498A in police station and put it in womens protection cell. Can i take back my complaint and reopen freshly before chargesheet even though they got bail. I appreciate your advice.

No, you should not take back your complaint. Instead while the complaint is still pending, you may file an application before the Magistrate seeking expeditious investigation of your complaint.
Even if you will file complaint to women cell they wll send the same to police to act so you cannot withdraw nor u file fresh

you can approach the high court for quashing the FIR and it is up to the court to decide.
