Legal Question in Family Law in India

Hello,

Iam looking for the advice on the Expartee Divorce.

I stay outside india .

The matter is settled and the amount is handed to my partner by cheque.

As I was unable to come to india,My lawyer has filed a divorce petition on my partners behalf and sent a notice to me.

In the divorce petition he has mentioned the amount was settled and the respondents(me) relatives handed over the cheque to the lady.

This was as per my lawyers plan to get me a Expartee Divorce.

I have received the notice 5 months back.

After that court didnt function for 3 months due to the Judge Abscence.

Now the matter is in trial, the Judge is unable to pass the decree with the reason they havent received the acknowledgment.

Now my lawyer is suggesting me to post a notarised letter to the judge ,

mentioning that iam unable to attend the court due to my problems and and have no objection to pass the divorce decree.

Please suggest me , whats my next step.

if i post a notarised letter , does the judge ask me to comedown?

(I cannot comedown now due to my present situation)

Why dont you go for Mutual Divorce by giving a power of attorney in favour of somebody in your relationships in India. They can proceed in India in your absence and you would get decree of Divorce form the competent court .
