Legal Question in Family Law in India
Hello,
I'm sending this message to help my cousin. He has been married for 3.5 years now and have a 1 year old daughter. His wife has been creating a problem for the entire family from the day they got married. She wants full freedom in the family and has Zero family values. The family is very helpful and supportive but everytime she was provided what she wanted, she started abusing it. For example, in their culture (they are from Rajasthan- Jaipur), ladies wear sarees and she wanted to wear salwar suit. After she was allowed to wear it, then she started wearing very obscene dresses which is totally against the culture. She just looks for anything in the family to fight and she specially hates her mother-in-law. She even called up police to make the things worse but in couple of hours in the police station, police figured out that she is trying to play a game and my cousin was told to go home. No FIR was filed.
Her family is totally supporting her in all of her wrong actions and they don't know that by doing all of this, they are spoiling their 1 year old kids future.
My cousin wants to get divorce and just cannot handle this anymore. He was laid off 3 months back and finally got a job but her wife fought with him saying that his salary is not going to be enough for her (he is going to get Rs. 7000). They are staying in the same house (on first floor) and his parents (they are on second floor) and parents are not in touch with her at all now after the police incident.
So, I need some advice on how can he get the divorce as he fears that she probably would ask for a big ransom amount to get him out of this Or she may even ask for parents property.
Any legal advice would be highly appreciated.
Thanks

It is better to file for a police case if any criminal act is committed and then file a divorce petition.
handle carefully. try to sort out the matter with a positive approach. it may be better to avoid litigation and settle the dispute amicably. the legal approach may create more problems and may be costly and time consuming with no certain results.
