need help...to restrain NRI husband from continuing divorce proceedings

thakns for the reply sir. to restrain my husband from divorce proceedings in foreign court, you said that I may file a suit in India seeking a declaration that the proceedings in US courts are inoperative and are not binding on me in any manner.''

under what section this suit should be filed? the suit will be filed in family court or civil court? I approached few lawyers in my place ,they said they do not know about this type of proceedings or case.pls advise me.Thanks in advance

I stand by my opinion. If my client permits, I may send you a copy of the order passed by one of the High Courts in India declaring that the proceedings by the husband in US Court for divorce will not affect the rights of the wife in India.

You cannot file such type of case but you can claim your rights from indian courts. Coz divorce in foreign courts are now applicable in India also but depends upon the treaty of India with that country. If you want to defend then our firm provide this servise also.

But if you want to claim your rights only then file a case of maintenance and other cases as advise by your local counsel in your court or you may contact us to get the justice and proper gudelines.

i don't know who gave you this type of advice, practically and legally no such case is maintainable in India.

i have already said you to contest the case here in from India and US courts also permit so.
