Legal Question in Family Law in India
hi.I got married with a girl Shilpa Sharma,in Jaipur on April,2008.Shilpa is daughter of Brij Mohan Sharma, who is working as a RAS officer in Jaipur.Shilpa was with me only for 5 months and then left me almost 1 year before from now and she and her parent never spoke to me after that.I tried calling a lot but they never recieved my call and never spoke to any of my family members.Meanwhile she filed 498A and Domestic vilonce against me and my family.I filed 482 in Jaipur high court to quash this FIR but her father managed to speak to judge personally and my case was disposed without any hearing.I filed for divorce case in my native place in BHilwara but her father filed transfer application in high court and civil stay has been placed over my case.I want divorce because I can`t live with this stupid girl again so how to get divorce ASAP.Should i file divorce case in Jaipur family court to expediate this matter?

You appeal against single Judge order i\of Jaipur High Court.
refrain yourself from disclosing the true identity of parties.
you may have to fight for your divorce petition by hiring a competent lawyer in jaipur. you need to defend your case cautiously and do not let your emotions ride your logic.
I agree with Mr.Rajiv,
Moreover once u have filed the case nw again u cannot file the same case on the same grounds. First u have to withdraw ur earlier case. Further u may get the divorce ASAP but i can guide u only after going through ur case and other cases filed by ur wife
Regards
You are facing double odds. First you need to change your attitude. there was no need of mentioning her name and her father's name; allegations like his speaking with the Judge may harm your case. It seems as if you are acting out of your mind. You need to maintain your cool and understand your situation.
It may be better for you to try for an Out of Court Settlement and avoid litigation. Even if a compromise is possible at "their terms", you may still be benefitted. Better to avoid litigation in this situation.
