Legal Question in Family Law in India

Hi.

I am married and living with my parents (in India) for more than one year b'cos me and my husband feel that we are not compatible with each other. Whenever we are together, we use to argue with each other on anything which we want to discuss or talk and always end up in quarrel. That's why we also dont have kids. Now i am in love with someone else and want to marry him. Can i get divorse from my husband and can i demand for a share in his property. Do i also have a right on his parent's property also which he will get ultimately after his parents. He also has one brother & one sister (both younger than him). He is living alone in delhi (not with his parents).

Is there any law which can help me.

Hi,

Please keep in mind, If you take Divorce you don't have any share in Husband's property, nor in his ancestral property. Max can happen is if your husband is ready for divorce, you both can apply for mutual divorce and get relief from each other.

If you apply for divorce, the chances of getting alimony are very less. So if you atleast love your second love, better discuss with your husband and take mutual divorce.

You have lot of rights to get Divorce from your husband with share in his property as alimony ..You have IPC , Crpc , Domestic Violence act and top it all Hindu Marriage Act to get what you dream.

if your ultimate object is to get divorce.then apply for divorce by mutual consent.if you remarry after divorce then you get nothing in any act whether it is domestic violence or any other act
