Legal Question in Family Law in India

Hi,
I am a married man with 2.5 yrs son. I have been married for 3.5 yrs now. I have a very bad equation with my wife with fights becoming a daily norm. She has in the past tried even suicide and gets abusive, physically hurts our son shouts and creates a scene on each and every occassion. She has run away from the house few times and keeps threatening me that she will shout, hurt my son, abuse and run away. Is that not enough justification to seek a divorce. I am ready to support them with the maintenace etc but I would like to separate from them. I love my son a lot but this behavior of hers is creating life a living hell for me.

In your situation you may seek help of your elders to make her understand the sanctity of marriage and still if she is abusive u may file a petition for divorce on the ground of cruelty.

try to settle the matter amicably and if you wish to divorce her try to go for divorce by mutual consent.

Mr.Anirudh is right. Further, if u want to file divorce then you may file the same. When child will become at age of 5 then court will provide custody of your child to you.
