Legal Question in Family Law in India

Hi,

I am a married woman and have a child who is now 3.5 years old. I was a sikh before marriage and had to convert to Islam so that I could marry my husband who is Muslim.I also had to keep a muslim name. However, all my legal documents like passport,driving licence,voter card,degree certificates etc. bear my name which I had before marriage.Now I want to get my son admitted in school but I am confused what will be his mother's mane: my new muslim name or the name which I had before marriage.My husband wants to put my muslim name on my son's birth certificate but I wish to keep my maiden name. What does the law say: can I put my maiden name or will I have to put my new muslim name which does not appear on any document like passport,driving licence,voter card,degree certificates etc.. Or can I put both the names. Will putting my muslim name on birth certificate and school certificates now on result in my identity crisis.Please advice. Many thanks in anticipation.

is your marriage registered as per special marriage act. in case it is and you have the certificate of registration, there is no problem. you can put any name and there is no bar in case you intend to put your maiden name even. in case your husband wants you to put your new name, you may put the same and there is no legal hurdle.
