Hi

I am Parthiban in Singapore, My wife in India, she filed the divorce case in indian and send all the legal document in India. My son ( 10 yrs old boy ) is studying in Singapore. She is working and earning more than Rs.35000 per month.

1. She is asking me maintenance Rs.50,000 per month.

2. She is asking me my son.

3. My son refused to stay with her.

Could you tell me, what will happend after gettting the divorce.

Really I don't want to give the divorce, 100% I need my and my Son need mother. pls. guide me

you need to immediately hire a lawyer in india so that a sufficient reply can be filed with regard to her petition in india. as you do not want to divorce her, we can, in her reply, ask her to join you in singapore. as the child is in singapore, there are very little chance of her getting the custody of her son in india.

First of all immediately hire a Lawyer here in India whereever is the case is. Secondly if she is working she cant demand for a maintanance. It is very difficult for her to get the custody of the child. You may also file Sec. 9

Since she is working, she may not be entitled to any maintenance. You may file your reply to her divorce petition. Since the child is already with you, an applicable for custody and appointment as guardian may be filed in the courts where you are staying with your son.

I wish your family may reunite once again.

As far as maintnece is concern she can not claim maintenance for herself as she is earning suffeciently.

You have to contest divorce caseso take necessary steps for filing your reply through your lawyer.

As far as custody is concern, she can not get custody of child from you.
