Legal Question in Family Law in India
hi
i have a question ,kindly advice me, if we go for mutual divorce, after 6 months of first motion ,is it mandate to serve 6 months period in 2nd motion too or can we request to waive off the 6months in the 2nd motion and request court to provide us with divorce decree????. what are the likely chances for the court to waive off the 6months period in 2nd motion????

The court cannot waive this period of six months now as has been directed by Supreme Court. You have to wait for six months to get your Decree of Divorce.

I agree with Mr. Kalra. The Supreme Court recently has held that the six months period between the two motions cannot be waived.
