Legal Question in Family Law in India

Hi,

My Husband filed a divorce petition U/s 27 SMA in jun 2009. And I filed an Interim Alimony petition U/s 36 & 38 in Jul 2009. IA is granted partialy Rs. 11000/- in Sep 2010. But my Husband is not paying IA. Family court has passed an order today that if he will not pay IA or not submitted the stay order from the HC, his petition will be dismissed.

What shall I do, if the petition dismissed? Shall I lose the arear IA amount that has granted? What are the action can be taken against him? Whether he will be punished by the court? What is the punishment for that?

I am not interest for the divorce. What are the good options for me to do?

Is the custody of child or children u/s 38 is with you or granted by the court ? What is the stage of Divorce proceedings u/s 27 ? You have Domestic violence act for your relief for interim maintainence and residence. Please clarify the above .
