Legal Question in Family Law in India

Hi,

My name is Neha and i just went through the second motion in divorce with mutual consent a few days back(in this month only). We have recorded our statement in front of the judge that time. The court papers are yet to come.

I want to remarry in January. My question is what is my status now? can all the functions related to my second marriage be performed without having received the papers yet? I hope its not illegal now as we already had the second motion.

Once the second motion has been recorded the court has to pass the decree of divorce. The decree is necessary before the second marriage. If it has been passed but you have not taken it that will be fine. In any case, All you have to do is to get your decree from the court which rightfully is yours and is free. You can go directly to the court and get the free copy of the decree under your signature.

if u have filed the divorce petition with mutual consent and court has recorded your statement than u should wait for the judgement of the court ones u got the decree of divorce than u are free to remarry u can remarry now also but if your previous husband withdraw the consent of divorce than u will in trouble therefore it is just and necessary to wait for decree of divorce fro the court

unless the decree of divorce is pronounced by the court, it is not advisable to marry.
