Legal Question in Family Law in India

Hi

My Sister in law has filed Domestic violence case in Gujarat -porbandar on me, my mother, father & brother(her husband). due to her earlier cases and harrasement my brother has left the house. same we have given in writting in the court but court is not accepting that.

at the time of accepting summons my mother had mentioned that he is not at home.

In absence of my brother we have filed reply for three of us.and case is going on.

under DV case she has asked for her shtridhan & maintenance.

In interim releif court has passed order to return her shtridhan (whatever mentioned in the list at the time of application) to all 4 of us. and interim maintenance of 5000/- from my brother.

She has not mentioned correct things in list and we are not able to return her shtridhan.now please suggest what we can do in absence of my brother. How court can pass order to us(her in laws) to return shtridhan ?

Do we have to go for appeal against intrim order ? if so what is the duration in which we should go for appeal?

If we go for appeal what will happen to the current case ?

Did you mention in your reply that you do not have all the stridhan articles or that the list is incorrect???

You may appeal in the sessions Court within 30 days of the Order. If you go in appeal, the current case may either be stayed as the papers will be called for in the sessions court or it may go on as well.
