i am hindu male.my father having some properties.we are three sons all are married.but one son is mentally ill(retarder person)
he also married. suddenly mentally ill son die leaves his wife as widow.now she wants some share.
some lawyers says that one son mentally ill. so inheritance is stooped so she can'not claim for portion.but she can claims maintenance

No one can claim your fathers property till he is alive and he can will or gift the same property to any one. If your father dies intestate then all the legal heirs of your father has equal share in his property and the widow of your retarded brother too has a share in the property.
