Legal Question in Family Law in India
Hi,
This is regarding domestic violence. One of my known is facing domestic violence from long time (say nearly 30 years). She is living in delhi with her husband and childern.
She is facing domestic violence majorily from her father in law. Her husband is also the victim of such domestic violence from her father in law (or, from his father). She was abused regarding her kids, she was troubled financially, she was and is tortured emotionally and still hearing abusive words for her & her immediate family members (her husband, her kids) from her father in law and rest all sons of her father in law (except her husband).
Her father in law had beaten her husband several times in past and had disturbed her emotionally. Her father in law and brothers in law wants her to get out of the house with her husband and kids. Her concerns are:-
1. The property they are living in is acquired by father in law. She and her husband and kids were and are victims of domestic violence. she has any right to stay in the house?
2. Can she file a case against her in laws (except her husband and kids)?
3. From last 30 years, her in - laws are disturbing her and her immediate family (her husband and kids). now the situation is so that she has broked up and is not ready to compromise or forget the matter internally. she legally wants to get compensation for this torture or a house to stay for her (& her husband and kids) entire life. Is it possible?
4. What other possible ways are there?
5. What does she needs to prove these happenings (incidents of domestic violence) with her? Her all in-laws are united and she is living in compromising situation with her husband and kids.

your problem is serious and cannot be answered in detail on this site. you need to see a lawyer and move strategically in order to claim your desired reliefs. you may seek various orders under domestic violence laws such as restraint order against your father in law restraining him from committing any violence upon you and also seek other reliefs.
