Legal Question in Family Law in India

My husband is escaping from paying maintenance for the past 4 years. he is neither taking me and my daughter with him to lead a family life nor giving any permanent alimony. Divorce case is still pending. His whereabouts are known. no cell number. In the court i was granted Rs. 15000 per month. In the court he simply said, i have no money. He is linked with some other lady. He simply said neither said neither i vil give maintenance nor i will give divorce. Because if i give divorce then i have to pay monthly maintenance. I am also little doubtful that he got married to that lady. How should i deal this case.

I have his PAN NO and pass port no, PF number with me. Also he had not taken his last office PF amount, but applied for it. it is about 1.20 lac. can i link my maintenance to it.

kindly explain me how should i deal my case.

Have you filed any complaint before Crime against Women Cell against him ? Have you filed any maintenance application under the Domestic violence act ? You have lot of rights under the law to get maintenance and put your husband behind bar but it seems you are not following the right path to achieve your goals. Please clarify .

First of all when the Court has ordered for the amount of Rs. 15000 which your husband is not paying then you should have filed an application requesting the Court to issue Recovery warrant against your husband.

Secondly is your husband a Government employee?
