Legal Question in Family Law in India
My husband filed for divorce here in India and after that left to USA(Michigan) on H1B visa giving power of attorney to his father. He was very much in India at the time of filing the divorce and while giving power. I have a 9 months old baby girl. We are not abel to contact any one in his family and if we try their refrains us and also threatens us not to contact them. What are the duties of the father for her? There is absolutely no support from him for her. IS there a way to bring him back to India for teh case. Please guide me in the right way.

you may resort to a complaint u/s 125 crpc for claiming maintenance for yourself and the girl child. as he has deserted you, it is upto you to decide whether you want him or want to give him divorce. however, this decision may be taken mutually and for that you may talk to him and sort it out. unless there are specific orders for his extradition from a competent court of law, it may be difficult to call him back.

You have lot ways to trouble your husband and bring him back from Michigan.The company which has sponsored him for H1b ,you can inform the company not to sponsor him for Green card because of the cases ( criminal or matrimonial cases ) pending in India.
