i and my husband as per hma have taken a divorce and one yr old baby legal guardianship and permanent custody is with me and now i am getting married so can i use my second husband name in my baby passport or i need my second husband to adopt the baby and now my ex husband is not in india so what are the adoption procedure and can i alone do adoption as i hv legal guardianship ...

no, the adoption cannot be done this way and your first husband would remain the legal guardian of the child forever. the name can be changed only with the written consent of natural guardian/first husband.
