my husband is having an illegal affair wid his own sister in law and his family members r approving it and so i and my daughter were kicked of the house , we hav no contacts from past one year and he is not aggreeing to divorce as i am the social cover to his illicit affair. can i get a legal remarriage without passing thru divorce and not dragging my 2 yrs old baby to court premises.

U can file application under domestic violence act for monetary relief and for residential rights and 125 crpc for maintenance and u can make police complaint if u r with evidence and without getting divorce u can not marriage and for further clarification u can call m
you need to seek divorce before you go for a fresh alliance. without seeking divorce, you cannot go for remarriage.
