Legal Question in Family Law in India

My husband is previously married and have a girl child from the marriage..The child lives with the mother since 5 yrs without any guardianship rights to the father.The mother is not giving any opportunity to contact the child so far..The only contact is through the telephone which he does to the school..Can he get her full custody in the court of Indian law? Can he file for a case regarding the issue.?

he can apply for the custody as the child is above 5 years old.

yes he can get custody if he file the case for custody or visiting rights what ever he wants.
