I am husband.
I have divorce case in india. Opposite party is interested only in money , harrase my parents and me. Out of court settlement is not possible.
I am IT professional.
I am right now at out of india for long term.
I am getting my Basic salary in INR 13000/- and remaining in Dollar $3000 (SGD), which is not too much as per Singapore living cost.
Now if i need to pay 1/3 of my income , what income would be consider and how much income consider from outside india?
if i earn 3000$ then court will consider as Rs 1,20,000/- @ rate of 30 rs/dollar ?
My out of india income is less only for food,traveling and staying and can save little out of them.
If i settled out of india then 1/3 of what i need to pay ? Do i need to pay in dollar ?
on what basis court will decide maintaince amount that i need to pay to my wife ?
i have one elder sister 33 yrs , she is unmarried , my father is retired 76 yrs , he is getting pension.
my wife is not working however she is educated.

See it is not mandatory that you have to pay 1/3 of your total salary. 1/3 is the max. you would be required to pay which depends upon the court.
