Legal Question in Family Law in India

I am an indian citizen who filed for a divorce in 2004 in tirupathi. I lost my case and filed a case in Hydrabad's high court in 2007. Now sicne the case is getting delayed. I am paying my ex husband some money and getting his mutual consent. But the probabble court dates are in June and my visa expires in june. I need a few months to file for my visa extension. Is there a way i can get my divorcee by mutual consent without attending the court in june. I am afraid the guy wil lback off cause all he wants is for my life to get spoiled. either i loose my job or loose my chance to get divorced. Please help me.

in this situation, you may file the divorce by mutual consent, first hearing and then your husband will give a statement in the court and you can also depose before the court that you would be leaving the country and in your absence, an attorney of yours would give a statement on your behalf. after six months of recording of your first statement, the second motion can be filed and in that your attorney can appear on your behalf. in case you want, you can also extend your visa.
