i am an Indian citizen with an Indian passport, who got married to an american citizen(girl) in August 2009 and got a marriage certificate from usa as per christian rites in a church in usa.Now I along with my wife are in India and I want her to get PIO card.Can she get one.Can I register my marriage in India under special merriage act ,or is it necessary for us to register in India so that my wife can live in India for long time.What is the procedure?Will India adoption laws be same for us as for any other India.

in case your marriage is already registered in US, you need not get the same registered again in india. the certificate issued in US is valid in india. your wife is entitled for PIO and there is process for the same whereby you need to apply in FRRO (Foreign Residents Registration Office) at bhikaji cama place in new delhi and then your matter would be referred to Ministry of Home Affairs, Foreign Division and after following the due process and inquiry, your wife would be entitled to extended visa and then PIO card. an immigration lawyer in delhi would be of good help to you.

First your wife needs VISA to come to India. Since you are both in India now, Application for PIO can be made at the following addresses:

An application for issue of a PIO Card can be made at Indian Mission in the country where the applicant is ordinarily resident.

In case applicant is already in India on Long Term Visa (more than one year), then application for PIO can be made for issue of a PIO Card to the following authorities:

(A) Those residing in: -
