Legal Question in Family Law in India

Khula procedure

I have few questions appreciate if some one can help answer these.

1) We are Muslim couple I am sunni my wife is shia, I would like to know what is the khula procedure for the shia community or in a case like mine where husband is sunni and wife is shia.

2) If we decide on separation only and not divorce or khula who gets the custody of children as per the law which rules shia and sunni?

3) If we amicably decide on seperation and agree on certain points relating to children can we document those points and make that document legal so that we both are in a binding for children.

4) Will have to pay any alumni in case of khula or mutual separation?

5) How different is mutual separation from divorce?

Re: Khula procedure

You may better consider an amicable out of court settlement and may later obtain a court decree on that basis.
