1. If the interim maintenance order is passed by the Hon'ble Court, then it is supposed to be paid on the date of next hearing.

have you filed an application for grant of interim maintenance or not. secondly, it all depends upon the circumstances of the case. the judgment of high court that you are acquainted with, is about affluent husband. in case the husband has capacity to buy you a house, he must but he cannot be compelled to transfer that house in your name.

The application for interim maintenance has to be made before the court as final maintenance takes time. you can ask for accomodation under Domestic violence act but your husband should be financial able.

(1) Once an interim maintenance order is passed by the court, the payment is required to be made by the husband on the next date of hearing.

(2) A wife is entitled to separate living in the same house or in the same locality, depending upon the situation and financial strength of the parties, under the newly enacted Domestic Violence Act. You may need to approach the authorities under the Act or you may file an application in the court in the pending maintenance proceedings.
