On one hand you may contest Restitution of Conjugal rights on the ground that all efforts to call her to matrimonial home turned futile and on the other hand you file a case for divorce on the grounds of desertion, cruelty and if you strong evidence of child being of some one else then add adultery also by making that person a party too.
you may file divorce case
If the allegation being levelled by you is proved false, you may be guilty of committing very serious offences of cruelty. Therefore, be sure and be careful about such allegations. "seems to be" is too vague to be believed. You should be very sure if about your being OR not being father of the child.
