Hello lawguru pls help me i am in a big problem,i am one married woman and completed 9 years of my marriage one day i found my husband with his secertery had a physical relationship since that day i am too disturb and want divorce as early as possible i don,t want .I don,t want even monthly money for my surviving now i am completely fed up to that man pls let me know how i will get divorce as early as possible pls help me.

You can file Divorce under the grounds of adultery along with mental cruelty. Before you have to leave from your husb. Generally adultery ground alone will not work out, You have to state cruelties to made out Divorce.

Here, you have failed to mention your religion and type of marriage? Whether both have children or not?

You have two ways to get Divorce ,1) Mutual Consent Divorce in this Divorce you can get Divorce from your husband in 6 months time provided he agrees with you to give divorce. 2) and the 2nd one is Contesting Divorce in which you can take up one or more grounds from the act against your husband but this kind of Divorce would certainly takes lot of time.

If your husband is also ready to give divorce then go for mutual divorce. OR else go for a petition for divorce in the family court.

you didn't mention your religion and place of living and that incident.

If he too is ready to give divorce then go for mutual divorce otherwise go for contested divorce on ground of adultery, If you have sufficient proof to prove it.If not then other Ground will helpful

a solitary act of adultery is no ground for divorce. the spouse must be living in adultery. in this situation, you may get no ground for filing the divorce unless its a divorce by mutual consent.
