Legal Question in Family Law in India

thanks to all the lawyers who answered my previous queries.my friend wants to clarify a few more things before she hires a lawyer to file for divorce and yes she too is usa citizen.

1.if she decides to file in usa would she be required to go to usa or can file through us embassy??

2.what would be the approximate cost of filing and taking divorce in usa??(just a conservative estimate)

3.if she decided to file in india is 1 year cool off period applicabe or can she file any time she likes????(in an earlier ques i was told that its required only in case of mutual consent....but earlier i was told otherwise)...her husband is not agreeing to divorce

4.can u suggest the names of lawyers competent enough to handle the case????

My friend see if your friend is inclined to file for Divorce in India then she can file it anywhere as already told you. Now regarding the one year cooling period there is a way for everything. Kindly contact.

1) her personal presence in US for filing divorce is must.

2) Approach a Lawyer in USA

3) she can approach any lawguru or other lawyer who is nearby to her place of residence for filing divorce in india

filing the same in USA is pretty expensive but less time consuming. she would have to be there in US to file the same.
