Legal Question in Family Law in India

legal notice

In the family court I have to defend my divorce case and i am not in a position to arrange for a private advocate due to financial reasons. How the court will proceed with the case i.e. regarding alternate arrangements

genrally in family court, appointing an advocate is optional, if you want you can argue your case on your own. the only thing is laymen do not understand the procdures in court that's the reason lawyers are appointed. you appear before judge, he will guide what to do.. contact me with full details in case of further advice.

You can defend yourself by personal appearance.

First step is : prepare a reply to the petition you have received.

reply should be based on actual facts.

If you need any help to prepare your reply, send us a copy of the petition and your para-wise comments/response to each para - allegation - fact.

we will finalise a legal reply for you. No charges.

after pleadings are complete, the parties are required to lead evidence.

It would be better if you make efforts for an out of court settlement.

I had carefully gone into the facts narrated by you in your reference.

As you say that you are not in a position to arrange a private lawyer due to financial reasons . In these circumstances you can prefer to defend your case yourself if you can do. Secondly , you can apply for legal aid department to provide you a lawyer.
