Legal Question in Family Law in India
I am living in Mumbai. I got married in My 2003. My wife filed false 498(a) case against me and my family in Nov. 2004 after delivering female child. I tried to convince her after that but she was refused to come back. So I filed divorce case against her in May 2006.Which in still running and now in last stage.
Meanwhile I still tried to patch up with my wife. Using relatives, friends, court notice and ADR�s help (Court representative). ADR submitted report against my wife that only because of her attitude our marriage is on broken stage.
In Sep. 2010 we won the 498(a) case and after that time my wife got ready to come back home because of my daughter�s future (7 yr. old). But she put up conditions that I need to deposit Rs. 1,50,000 on my daughters name and should live separately from my mother. My economical conditions were completely against for this condition to handle two families.
My advocate told that my wife in only interested in money and not in marriage. So we continued divorce case. Court decided Rs. 2000/- amount for her maintenance which is paying by me on time to time till date.
My advocate advised me to submit last salary slip and company detail which were with lower scale. Now am working at Pune in PRIVATE job and do daily travel between Mumbai-Pune. And getting salary around 20000. I shared this things with my wife once, as she were asking for that and in very next court date wife�s advocate proved this in court that am having good salary and submitted false record for salary.
I am very very much scared now as my mother has serious health issues this time I am having below queries:
1. Will court punish me for submitting false salary document?
2. Will court will reject my divorce and force me to live with my wife with her conditions?
2. Will I be force to pay my wife maintenance as well as whole marriage expenses? If yes, what if I lost my job. Because when court notice come to my office for asking salary slip, my office is not so much happy with me.
I am very much fed up with all this emotional blackmailing by wife. Even not in position to live or die as my mother need to this time. Where she will go, if some mismatch happens with me?
Can anybody guide me on this what to do?
