Legal Question in Family Law in India

hi, I have lodged a 498a complaint. the police arrested my in-laws and they obtained bail also. as my husband reside in london, the court issued NBW against my husband 2 years ago. my husband approached the high court for anticipatory bail in feb 2009. the high court dismissed his petiiton and directed him to surrender before lower court in 30 days time that is before 31-03 -2009. but my husbnad did not surrender in lower court even after high court direction. as he is not coming to india, his passport was impounded 2 months ago. I came to know that he is approaching either district court or high court to request the court to give some time to surrender himself before lower court as he reside in london and not getting leave immediately and if he comes immediately he may loose his job. I know that to escape from passport impounding, NBW's should be cancelled.So he is approaching distrcit court or high court by suppressing all the factes and obtain time like 6 months..

As it is a police case, in district court or in high court public prosecutor will be there to argue on behalf of state or police. but my husband may manage them.

I know that in quash and writ petitions , I can appoint lawyers in high court to reprsent me.

So I have a question here,

in addition to public prosecutor,can I appoint a lawyer who represent me in district or high court when my husband bail petiiton or request for enlarging some time to surrender him self in lower court ?

does the distrcit allow my lawyer to represent my self in this bail or time enlarment peitions?

yes u can appoint any advocate and he will look after the list of cases day by day and appear whenever ur husband will appear in court for bail or quashing. Let us know ur location, may be our team can help u..

You cannot appoint lawyer in such a case.

there is no basis to presume that the public prosecutor or the other government advocates are amenable to his influence. in any case, you are entitled to engage your private lawyer who should represent you in all such proceedings as you may direct.
