Legal Question in Family Law in India

love marriage..

sir iam in love with a girl and she too loves me very much. recently after knowing our love affair, girls mother

made her to sign a document and she was not aware of its contents and the meaning. now with some unusual developments happening in her house,we both are fearing that i may be some

marriage agreement document which she signed. girl says that document may have been signed by other person too,

whom girls parents have choosed for her marriage. girl is now 21 and she will

complete her education after two and half months. we both are planning for register marriage after her education. sir will this document which she signed with out knowing, will create any legal problem for our register marriage. if at all it creates any problem, how can we overcome that problem and get married.

sir she comes from orrisa and i am from andhrapradesh. another interesting legal

fact about the girl is that, she has been adopted by her parents. sir girls parents

have foreseen that she would come with me and marry me,which is why they are

planning all these things. sir how can we overcome these legal obstacles and get

married.

Dear sir,

Unless and untill the contents of document is not known how the legal implications an be anticipated.In India no agreement in relation to marriage prevails.Adopted child is also the child of the family as if natural child is born and has all rights.If you both are major then go for marriage. I donot see any alleged obstacle.

Every woman had a fundamental right to marry with her own sweet will. Being major she is free to move anywhere and no one can restirct her even if she doenst marrries u she may live with u.

If she thniks that some fraud has been done with her she may notify the same to the police station immidiately.

Recently the supreme court has given a direction in a decision Reported in 2006(2) Supreme court cases (criminal)

PARA 17. It is therefore directed that the administation/police autorities throughout the country will see to it that if any boy or girl who is a major, undergoes inter caste or inter religious marriage with a woman or man whi is a major, the couple is not harassed by anyone not subfected to threats or acts of violence, and anyone who gives such threats or harasses or commits acts of violence either himself or at his instigation,is taken to task of instituting criminal proceedings by the police against such persons and further sern action is taken against such person as provided by law.
