Legal Question in Family Law in India

i m 27 years old.

i got married on nov 2009. i lived with my husband (CA)and in laws for six months. i m still virgin as my husband was not interested in keeping any relationship. he and his family gave me mental torture. they r very cunning and didnt give me any physical torture which i can prove .

i was under impression of impotency (mental or physical). in sep.2010 i came to know about his secret affair.

i m at my parents' place for last 4 months. in both the above mentioned causes he has purposely ruined my and my family's peaceful and happy life.

unfortunately i dont have enough proof for both causes.

i was lecturer (earning 9000p.m.)but now i m job less.

what should i do?

Up to November 2010 you may file for annulment of marriage for marriage having not been consummated.

After November 2010, you may file for divorce on the grounds of cruelty having been caused for not consummating the marriage, for extra marital relationship - your statement is the proof, behaviour of the inlaws.

In addition, you may file for maintainance under the Domestic Violence Act.

If you want to settle amicably, talk it out to him or approach Mediation Centre for pre-litigation mediation.

Speaking frankly it is you who has to decide as to what and how you want to proceed. If you wish that your marital life should be saved any how then you have to proceed in that manner. But if you want to finish off with your marital life you should move accordingly. BUT BEFORE PROCEEDING IN SUCH WAY THINK TWICE. No one in this world can tell you as to how you should be proceeding further. It is only you who has to think over it and proceed as it is your life and your marriage.
