Legal Question in Family Law in India

i made DV Complaint against husband and sister inlaw.Husband abroad.

case is done because of mental cruelty,desertion,return of streedhan,maintenance,compensation, etc.

i am well qualified BUT NOT WORKING.

can the other party's lawyer use my qualification as a ground to deny me maintenace?my husband is abroad and earns in lakhs.

You may be entitled to maintenance on the basis of financial standing of your husband at the time of separation.

even though u qualified but it is not a ground to mitigate the maintenance to be paid to you by your husband who is drawing a good salary abroad. you need to prove his salary in the court in order to get maintenance that commensurate his earning capacity.
