Legal Question in Family Law in India
Maintainance for deserting wife / Threat of flase case
Wife, left home on a flimsy reason. Constantly, pressurising me to abandon aged parents & live as a support to her parents in her hometown. In 2 years of married life constantly pressurising me to finance her fathers needs. Tried several times to negotiate with her family for her return, but her family is very adamant on their demands. They have several times in the past given threats of implicating me false cases of taking dowry & torturing her for financial gains. No money was exchanged during marriage. No dowry taken. Asking me to sign documents, with unreasonable demands (being asked to transfer flat & car ownership to them). All talks have come to naught. Wife is very well educated & is capable of supporting herself. Have a 1 year old daughter, currently with her.
If I file for RCR then she might counter it with false cases, also she might claim maintainance. Since I work outside the country they might claim huge maintainance inline with my salary, even though she is capable of working (inspite of me willing to take her back). My salary on paper is a very high amount, but I have a lot of liabilities like old parents, sister, personal Insurance, Retirement plans not provided by my Employer. Please advice the best way forward

gentleman, the best way forward for you would be for an amicable settlement with your wife on WHATEVER terms possible; in crude language, buy peace by making "one time payment" of whatever amount it can be agreed upon by her; standing on ceremonies and ego, AND delay will be more harmful to you; litigation may not be very fruitful; in law she has an upper hand;
OR you compeltly ignore the issue and maintain a stony silence to test their patience - may be for an year or so.
I would rather stick to my first option and go for a mutual settlement at ANY cost.
