Re: maintenance

(a) Maintenance is determined on the basis of income of the parties.

a wife is entitled to live life in terms of standard of living of the husband.

usually, the courts awards 20% to 35% of husband's income for maintenance of wife and children; it depends on a number of other attending circumstances and situations which the courts takes into consideration.

(b) the child being 8 years old, her wish would also be considered by the court for grant of custody;

at this stage/age of the child, joint custody is preferred.

The best solution is to try for an amicable settlement with your wife instead of continuing this litigation.
